Sri.Shetty Vignesh Shivaram., counsel for the petitioner and Sri.M.N.Kumar., counsel for respondent No.1 have appeared in person. 2.
The petition is filed seeking following reliefs: a) Issue a Writ of Certiorari or any other writ, order or direction setting aside the impugned order dated:25.03.2026 passed by the respondent in RC.No.35/2020 in O.A.No.205/2019 vide Annexure-A. b) Issue a Writ of Mandamus or any other direction to revalidate the sale certificate dated:28.05.2025 issued by the respondent in RC No.35/2020 in O.A.No.205/2019 as per present RTC and issue new sale certificate as per by incorporating the new survey hissa numbers vide Annexure-D. c) Further be pleased to grant any other relief or reliefs that this Hon'ble Court may deem fit and proper under the circumstances and facts of the case including the cost of this proceedings, in the interest of justice and equity. 3. Counsel for the petitioner and respondent No.1 urged several contentions. Heard the arguments and perused the papers with care. - 4 -

The petitioner - Bank is seeking a direction to revalidate the sale certificate dated:28.05.2025 issued by the respondent in RC No.35/2020 in O.A.No.205/2019 as per present RTC and issue new sale certificate as per by incorporating the new survey hissa numbers. Such a prayer cannot be accorded in a writ petition. However, the petitioner is at a liberty to agitate its grievance by filing an appeal before the DRT, as per the statutory provisions. If such an appeal is filed by the petitioner, the DRT is directed to dispose of the same within six weeks from the date of filing of the appeal. The time spent by the petitioner before this Court is excluded. 5. Accordingly, the writ petition is disposed of. Because of disposal of the Writ Petition, interim order granted if any stands discharged and pending interlocutory applications if any are disposed of. Sd/- (JYOTI M) JUDGE
