Rakib (Allowed) CRM (M) 2803 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bhowanipore Police Station case no. 294 of 2022 dated 12.12.2022 under Sections 120B/170/395/397/467/468/471/34 of the Indian Penal Code read with Sections 25(1B)(a)/27 of the Arms Act. And In the matter of : Nurnobi Sk @ Choton ……Petitioner. Mr. Satadru Lahiri Mr. Jyotirmoy Talukder .....for the Petitioner. Mr. Rajendra Banerjee, Ld. APP Mr. Imran Siddiqui ……for the State. Learned advocate appearing for the petitioner has referred to the order of bail passed by the Hon’ble Supreme Court in Special Leave to Appeal (Crl.) No. 16546/2025. The grounds on which the co-accused has been granted bail by the Hon’ble Supreme Court was that petitioner is in custody for more than three years and that the trial would likely to take some time for completion. The present petitioner was arrested on December, 2022 and since then he is in custody. Having considered that the petitioner is facing the same trial as that of the other accused who has been granted bail, I am of the opinion that considering the period of detention of the present petitioner, without entering into the merits of the case the same benefit be extended to the petitioner. Accordingly, the prayer for bail of the petitioner is allowed. 2 As such, the petitioner, namely, Nurnobi Sk @ Choton shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Alipore, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Kolkata and South 24 Parganas without prior permission of the learned Trial Court. Thus, CRM (M) No. 2803 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
