In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Gangarampur P.S case no. 739 of 2025 dated 21/11/2025 under sections 85/117(2)/64(1)/351(2)/3(5) of the BNS. In the matter of: Jayanta Roy ...Petitioner. Ms. J. Rudra …for the petitioner. Ms. Priti Kar Bagchi …for the State.
1. Report filed on behalf of the State is taken on record.
2. Despite service, no one appears on behalf of the de-facto complainant.
3. Learned counsel appearing on behalf of the petitioner submits that he has been falsely implicated in this case. He is a distant in-law of the alleged victim.
4. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statement of the victim recorded before the learned Magistrate, the medical examination report and the statements of other witnesses including neighbours.
5. Considering the above, the other incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

6. Accordingly, the application for anticipatory bail is rejected.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
