Ajay Mohan Goel, Judge (Oral) When this case was taken up for consideration, learned Counsel for the petitioner submits that the petitioner had filed this petition against the passed by Deputy Commissioner, Mandi, District Mandi, H.P., on the ground of lack of jurisdiction of the said Authority to pass the impugned order. Learned Counsel further submits that in fact, the petitioner also availed the right of statutory appeal against the order passed by the Deputy Commissioner, which has been dismissed by the Appellate Authority. He submits that in these circumstances, the petitioner be allowed to withdraw the petition with liberty to file a fresh petition on the same cause as also the subsequent events. 2. The petition is dismissed as withdrawn, with liberty, as prayed for, so also the pending miscellaneous application(s), if any.
