Sheikhpura, after celebrating the birthday party of our friend Lovely, resident of Bal Pabana, were standing at the bus stand. At that time, in front of counter no. 9/10, Rupesh alias Rupa resident of Gagsina, Krish son of Sanjay resident of Achla, Sucha alias Sachin Narwal resident of Narukhedi, Ashish resident of Uncha Samana, Pradeep resident of Malikpur and several other boys came and said that why are you wearing the ITI uniform, we hate this dress. Remove this dress immediately. When I refused to remove the uniform, Ashish resident of Uncha Samana pushed me and his companions Rupesh alias Rupa, Krish, Sachin Narwal alias Sucha, Pradeep and their other associates attacked me with knives. The knife blows hit me at two places on my waist, on my shoulder, on my chest and on my face. I made a lot of efforts to defend myself. Thinking that I was dead, all the assailants fled from the spot along with their knives.
All Rupesh alias Rupa, Krish, Sachin Narwal alias Sucha, Ashish, Pradeep and several other boys have carried out a murderous attack on me with the intention to kill. Kindly take legal action against all of them. The statement has been written, read over and heard, which is correct. Sd/- Lavish”

Learned counsel for the petitioner submits that even as per the allegations levelled in the FIR, the only role attributed to the petitioner is that he gave a push to the complainant and is not in any manner involved in causing injuries to him. Learned counsel further refers to the disclosure statement of a co-accused Sachin wherein, no role has been attributed to the petitioner. Learned counsel submits that the petitioner is a young boy aged 20 years and is in custody since 14.01.2026 and almost 6 months have gone by. He submits that further custody of a young person would be detrimental to his interest. Learned counsel further submits that final report has also been submitted and though charges have been framed, no prosecution witness has been examined and, therefore, trial will take a sufficiently long time to conclude. Under the circumstances, he prays that no useful purpose would be served by keeping the petitioner in custody any longer. Learned counsel also submits that the petitioner has clean antecedents and there is no other case registered against him. 5. Per contra, learned counsel representing the State has opposed the bail petition stating that 5 injuries were caused to the complainant, which have been collectively declared to be dangerous to life. It has been submitted that in case the petitioner is released on bail, he shall try to threaten and influence the witnesses and may also abscond. 6. I have given my thoughtful consideration on the issue in hand. 7. No doubt, the issue is serious. The complainant suffered 5 injuries most of which were incised wounds. However, the fact which has to be kept in mind is that the role attributed to the petitioner is that of he having given a push to the complainant and thereafter, there is no allegation against him either in the FIR or in the disclosure statement. It is also to be kept in mind that the petitioner is a young boy aged 20 years having no criminal background. For such a person to remain in jail for a long period would also be counter protective. Investigation stands completed and final report has been submitted. In the considered opinion of this Court, no useful purpose would be served by keeping the petitioner in custody any longer. 8.
In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.
