JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 4 – husband and his family members are before this Court calling in question proceedings - 3 - HC-KAR NC: 2026:KHC:31645 CRL.P No. 6544 of 2026 in C.C.No.55460/2024, pending before the 29th Additional Chief Metropolitan Magistrate Court, Mayohall, Bengaluru, for offences punishable under Sections 498A, 504, 323 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners – accused and respondent No.2 – complainant, in unison would submit that the parties to the lis were before the concerned family Court in M.C.No.7456/2025 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions before the mediation center. They have parted their ways by obtaining a decree of divorce by mutual consent. Therefore, the parties are before this Court seeking permission to compound the offences. They have filed appended a certified copy of the memorandum of settlement to the petition. 3. The memorandum of settlement reads as follows: “I. The Petitioners have filed a joint petition under Section 13-B of the Hindu Marriage Act, for dissolution of their marriage by mutual consent. II. The Hon'ble Court has waived off the statutory period of six months vide its order dated 06.12.2025. - 4 - HC-KAR NC: 2026:KHC:31645 CRL.P No. 6544 of 2026 III. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of mediation, both petitioners and their counsel were present and the parties have resolved their dispute and have agreed to the following terms and conditions: 1. The petitioners are Hindus by religion and they state that their marriage was solemnized on 30.05.2019 at Annapoorneshwari Kalyana Mantapa, Bengaluru as per Hindu rites and customs. 2. Due to irreconcilable differences and incompatibility of temperaments, the petitioners have been living separately from June 2020. The efforts made by the elders, friends and well-wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of reunion amongst them. Hence, the petitioners have decided to get the marriage between themselves dissolved by a decree of divorce mutually. 3. Both the petitioners state that they have no children born to them from this marriage. 4. The 1st petitioner has agreed to pay a sum of Rs.15,00,000/- (Rupees Fifteen Lakhs Only) to the 2nd petitioner towards all her claims of permanent alimony/maintenance as full and final settlement by way of following manner: a) A sum of Rs.5,00,000/-(Rupees Five Lakhs Only) already paid at the time of filling this petition by 1st petitioner to the 2nd petitioner and the 2nd petitioner acknowledges the receipt of the same. b) A sum of Rs.5,00,000/-(Rupees Five Lakhs Only) will be paid by way of Demand Draft bearing No.525062, dated 18.12.2025 drawn on Karnataka Bank, Ramanagar Branch, Ramangar and the same will be handed over to the 2nd petitioner at the time of reporting the settlement before the Hon'ble Court. c) The balance amount of Rs.5,00,000/- (Rupees Five Lakhs Only) will be paid at the time of quashing proceeding, likely to be filed before the Hon'ble High Court of Karnataka seeking quashing of C.C. No.55460/2024, pending before XXIX CJM, Bengaluru. - 5 - HC-KAR NC: 2026:KHC:31645 CRL.P No. 6544 of 2026 5. Both the petitioners state that they have no claims over the movable or immovable properties either existing or to be acquired in future. 6. Both the petitioners state that they have already exchanged their valuable gold articles and household articles. 7. Both the petitioners further agree that they have no other claim of whatsoever manner against each other either past, present or future. 8. In view of this settlement agreement, the 2nd petitioner has agreed to co-operate in closing/quashing in C.C. No.55460/2024, pending before 29th ACIM, Bengaluru. 9. In view of this settlement agreement, the 2nd petitioner has agreed to not to prosecute further in M.C. No.1926/2022, on the file of III Additional Family Court, Bengaluru which is already disposed. 10. Both the petitioners further state that there has been no collusion or force, fraud or any undue influence in entering into this settlement /agreement in the aforesaid manner. 12. Both the parties hereby indemnify each other that they shall refrain themselves from any kind of a post/photos/screenshot etc., from publishing in any social media involving other persons. IV. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 30.05.2019 at Annapoorneshwari Kalyana Mantapa, Bengaluru pass a decree and judgment in terms of the aforesaid agreement by way of mutual consent. V. Parties will appear on 19.12.2025 before the Court for passing orders in terms of the agreement.” In the light of the afore-quoted memorandum of settlement, I deem it appropriate to terminate the proceedings - 6 - HC-KAR NC: 2026:KHC:31645 CRL.P No. 6544 of 2026 against the petitioners as it is a matrimonial dispute and the allegations are not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The impugned proceedings in C.C.No.55460/2024, pending before the 29th Additional Chief Metropolitan Magistrate Court, Mayohall, Bengaluru, stand quashed.
