Mazumder … for the Petitioner(s) Mr. Koustav Lal Mukherjee … for the State-respondent(s) Mr. Sujan Chatterjee … for the defacto-complainant Learned advocate for the petitioner prays for bail and draws the attention of the court to the evidence of the victim girl and other witnesses who deposed before the learned trial court. Learned advocate for the defacto-complainant is present and do not raise any objection to the prayer of bail. Learned advocate for the State is present and opposes the prayer for bail. I have taken into account the order dated 27.04.2026 and the spirit of the order by which the bail was rejected by the learned Special Court. Having considered the same, I am of the opinion that the petitioner be released on bail. 2 Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Latib Sk. @ Latif Sekh shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Special Court under POCSO Act, Berhampore, Murshidabad. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court. Accordingly, CRM (M) 1144 of 2026 is allowed.
