CRM-M-25843-2026 1 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 222 CRM-M-25843-2026 Decided on : 06.07.2026 RAVINDER KUMAR ......PETITIONER Versus STATE OF HARYANA ......RESPONDENT CORAM: HON'BLE MR. JUSTICE SANJAY VASHISTH Present: Mr. R. Krishnaamorthi, Advocate for the petitioner. Mr. Birender Bikram Attrey, AAG, Haryana. ***** SANJAY VASHISTH, J. 1. The instant second petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), seeking grant of regular bail in case FIR No.67 dated 28.02.2025, under Sections 22(c)/21(b)/29/61/85 of NDPS Act, 1985, registered at Police Station Sadar Ballabgarh, District Faridabad. 2. As per allegations in the FIR, role of the petitioner is that he was apprehended by the investigating officer at the spot with Hyundi Aura Car bearing Registration No. HR-30W-6527 which was registered in the name of the petitioner’s wife-Jyoti and 35 different types of allopathic medicines and MTP Kit, two boxes of Alprazolam Tables IP Alprazo 0.5 Batch No. AT241001g Mfg dated 10/2024, Expiry dated 09/2026, Manufactured by Addii Biotech Pvt. Ltd. village Bhatauli Khurd, PO Page 1 of 4 Pages PRIYANKA 2026.07.07 19:04 I attest to the accuracy and integrity of this document CRM-M-25843-2026 2 Baddi 173205, was recovered. On weighing 10 Alprazolam Tablets, they were found to be 1.44 grams as such, 1200 Tablets were found to be 172.8 grams were recovered. The quantity of recovered contraband substance is commercial quantity. 3. Learned counsel for the petitioner argues that petitioner is aged about 48 years, and is having a family to maintain, consisting of his wife and two children who are studying in Class 9th and Class 10th respectively. Entire family of the petitioner is surviving upon the mercy of family friends and relatives since 28.02.2025. The petitioner has no criminal antecedents. 4. Learned counsel further submits that co-accused of the petitioner, namely, Visha Bandhu and Parveen Goyal have been granted regular bail vide orders dated 14.01.2026 and 19.01.2026 (Annexures P-4 and P-5) respectively whereas co-accused Deepak Bansal has been granted anticipatory bail vide order dated 23.02.2026 (Annexure P-6). 5. Besides, learned counsel submits that out of total cited 20 prosecution witnesses, none has been examined. Thus, conclusion of trial is likely to take considerable time. Accordingly, in the given circumstances, and on the ground of parity also, prayer has been made for grant of regular bail to the petitioner. 6. On the other hand, learned State counsel, while vehemently opposing the prayer for bail, submits that the quantity of contraband recovered in the present case is commercial in nature and, therefore, the rigours of Section 37 of the NDPS Act are attracted. Learned State counsel also submits that merely because co- accused have been granted concession of regular bail, petitioner cannot claim parity as a matter of right, particularly when he was apprehended by the investigating officer at the spot with Hyundi Aura Car bearing Page 2 of 4 Pages PRIYANKA 2026.07.07 19:04 I attest to the accuracy and integrity of this document CRM-M-25843-2026 3 Registration No. HR-30W-6527 which was registered in the name of the petitioner’s wife-Jyoti and contraband in commercial quantity has been recovered from him. 7. I have considered the rival submissions advanced by learned counsel for the parties and gone through the record. 8. Earlier bail petition i.e. CRM-M-7598-2026 was withdrawn by the counsel for petitioner at that stage because petitioner was in custody for a period of only 11 months and 13 days and same was disposed of on 13.02.2026. Now after undergoing an incarceration for a period of one and half year, instant petition has been filed by the petitioner. It is further a matter of record that co-accused have already been granted concession of regular bail by this Court. Thus, case of the present petitioner deserves consideration on the ground of parity as well. Besides, it has also come on record that out of total cited 20 prosecution witnesses, none has been examined. Therefore, conclusion of trial is likely to take considerable time. 9. Keeping in view the age of the petitioner, who is stated to be about 48 years, and considering the overall facts and circumstances of the case, this Court finds it appropriate to afford one more opportunity to the petitioner to join the normal course of life and to rehabilitate himself in society. Thus, in view the principle of parity; stage of trial; and without expressing any opinion on the merits of the case, this Court is of the considered view that the rigours of Section 37 of the NDPS Act stand satisfied to a limited extent for the purpose of grant of bail. Accordingly, this Court deems it appropriate to grant the concession of regular bail to the petitioner. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 10. Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 11. The observation made here-in-above shall not be construed as an expression of opinion on the facts of the case and the Trial Court is expected to decide the case on the basis of complete evidence available on record. 12. It is further made clear that if, in future, petitioner is directly found indulged in similar kind of activities, this order shall be deemed to be cancelled. 13. Petition stands disposed of. Misc. application(s), if any, also stand disposed of.
