APHC010659922011 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI WRIT PETITION NO: 29901 of 2011 Bench Sr.No:-6 [3552] R. Swaraj Kumar Reddy and others ...Petitioners Vs. Government of Andhra Pradesh, represented by its Principal Secretary and others ...Respondents ********** Advocate for petitioners : Sri K. S. Murthy, learned Senior Counsel. Advocate for respondents : Learned Government Pleader for Social Welfare, learned Government Pleader for Panchayat Raj and Rural Development CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 5th January 2026 P C : The issue that has been highlighted in the present petition is that the official respondents are trying to construct a road which will go through the premises of the Zilla Parishad High School for Girls in Pileru Village, Chittoor District, which is being done for the benefit of real estate developers. 2. By virtue of an order dated 10.11.2011, a Coordinate Bench of this Court had granted interim relief and ordered suspension of the order impugned in the present petition. 2 3. Learned counsel for the petitioners would urge that the road even otherwise lying within the premises of the Z.P. Girls High School would affect the welfare and security of the girl students. 4. It can be seen with reference to the counter affidavit filed by the respondents that land to an extent of Ac.6-62 cents falling under Sy.No.262 was classified as ‘Government Poramboke’ (waste land) in Pileru Village. The land was stated to have been sub-divided into 262/1 to 262/6 through proceedings dated 22.06.2010 of the District Collector, Chittoor. Out of the total extent of Ac.6-62 cents, an extent of Ac.1-15 cents falling in Sy.No.262/1 was earmarked for B.C. Welfare Girls Hostels, Ac.0-35 cents in Sy.No.262/2 was earmarked for B.C. College Girls Hostel and Ac.0-30 cents in Sy.No.262/3 is stated to have been earmarked for road whereas Ac.4-04 cents in Sy.No.262/4 was earmarked for Z.P. Girls High School. Apart from this, Ac.0-70 cents in Sy.No.262/5 was earmarked for S.C. Boys Hostel and Ac.0-80 cents in Sy.No.262/6 was earmarked for road in the said village. 5. The main grievance of the petitioners is that if the road is permitted to be constructed, it would run through the premises which is currently in occupation of the school and would divide the Z.P. Girls High School which would render the girl students studying in the school as also residing in the hostel liable to insecurity. 6. It is not denied that the pathway which is earmarked for the construction of the road lies between the Z.P. Girls High School as also the Girls Hostel. In 3 our opinion, this would affect the security of the girl students studying in the hostel and the school. 7. We, therefore, make the interim order dated 10.11.2011 absolute giving liberty to the official respondents to provide for access through the land other than the land which is in occupation of the Z.P. Girls High School as also the hostel. The authorities shall also enable the construction of a compound wall for securing the girl students who are residing or studying in the said school. 8. Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed. DHIRAJ SINGH THAKUR, CJ CHALLA GUNARANJAN, J AMD 4 05 HON’BLE MR. JUSTICE DHIRAJ SINGH THAKUR, CHIEF JUSTICE & HON’BLE MR. JUSTICE CHALLA GUNARANJAN WRIT PETITION NO: 29901 of 2011 Dt:05.01.2026 AMD
