P.P. --------- 02/23.09.2026 Heard Mr. Anjani Kumar, learned counsel for the appellant and learned Spl. P.P. for the State. This appeal is directed against the order dated 12.08.2026 passed in Misc. Criminal Application No. 600 of 2026, arising out of Jaraikela P.S. Case No. 01/2026, corresponding to S.T. Case No. 230 of 2026, by the learned Sessions Judge, West Singhbhum at Chaibasa, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the appellant and the other accused persons were providing shelter and food to the extremists. Submission has been advanced by the learned counsel for the appellant that the appellant is in custody since 02.01.2026. It has been submitted that the appellant does not have any criminal antecedent and in fact there is no allegation that the appellant was directly involved in causing harm to the Police party rather the appellant was virtually forced to harbour the extremists and providing shelter and food to them. Learned Spl. P.P. for the State has opposed the prayer for bail of the appellant. Regard being had to the role of the appellant which seems to be primarily on account of compulsion and the period of custody undergone by him, we while setting aside the order dated 12.08.2026 passed in Misc. Criminal Application No. 600 of 2026, arising out of Jaraikela P.S. Case No. 01/2026, corresponding to S.T. Case No. 230 of 2026, by the learned Sessions Judge, West Singhbhum at Chaibasa, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, West Singhbhum at Chaibasa in S.T. Case No. 230 of 2026, arising out of Jaraikela P.S. Case No. 01/2026, subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till the conclusion of the trial, unless prevented by sufficient cause.
