V SURENDRA REDDY Counsel for the Respondent(S): 1. GP FOR HOME 2. RAM BABU DEVAVARAPU 3. GP FOR REVENUE 4. GP FOR REGISTRATION AND STAMPS The Court made the following: 3 CMR,J & GTK,J W.A.No.1323 of 2025 JUDGMENT: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) Without challenging the order dated 18.11.2025 of the learned Single Judge passed in Writ Petition No.8921 of 2024, whereby the writ petition was closed giving liberty to the petitioner to challenge the order dated 03.08.2023 of the District Registrar before the appropriate forum and modifying the interim order dated 16.05.2024, the present writ appeal has been filed. 2. Heard Mr.V.Surendra Reddy, learned counsel for the appellant, learned Government Pleader for Revenue for respondent Nos.1 to 7 and Mr.D.Ram Babu, learned counsel for respondent Nos.8 to 15. 3. As per the order dated 03.08.2023, the District Registrar, in exercise of his power under Section 82 of Indian Stamp Act has ordered to prosecute the erring officers namely (1) Sri Dubagunta Gopi Krishnamurthy, (2) Sri Vadivel A.C., (3) Sri Daggumati Sreedhara Rao, (4) Sri Devarapu Mahendra, (5) Sri Kukati Kondaiah and (6) Sri Shaik Allabakshu, as per the instructions of the Commissioner and Inspector General issued vide Memo No.G1/1843/2015, dated 08.04.2025. The writ petitioner has prayed for a direction to declare the unilateral cancellation of registered sale deeds as illegal and prayed for other reliefs. 4. After hearing both the counsel, the learned Single Judge closed the said writ petition by the impugned order on the ground that the writ petitioner has not assailed the said orders and only consequential action has been assailed. While closing the writ petition, it is observed that, in view of the above, the interim order passed in the writ petition dated 16.05.2024 was modified. 5. Learned counsel for the appellant would submit that he would challenge the order dated 03.08.2023 of the District Registrar, as directed by the learned Single Judge. But his grievance is only relating to the observation made by the learned Single Judge relating to the modification of the interim order dated 16.05.2024. He contends that what is the modification and in what 4 CMR,J & GTK,J W.A.No.1323 of 2025 manner the interim order was modified is not made clear and it is ambiguous. Therefore, his limited grievance in this writ appeal is only relating to the said vague order passed modifying the interim order. 6. The interim order dated 16.05.2024 pertains to the direction not to cancel the document Nos.2139 to 2142 of 2023 on the file of the Sub-Registrar Office, Stonehousepet, Nellore City, till the date of next adjournment. 7. We do not think that any clarification is required to be given in this appeal relating to the said vague order of modification ordered by the learned Single Judge pertaining to the aforesaid interim relief. Suffice it to say that when the main writ petition itself is disposed of or closed, as per law the interim orders passed therein stands co-terminated. Therefore, the question of modifying the interim order when the main writ petition itself is closed does not arise at all. Clarifying the said doubt expressed by the learned counsel for the appellant, this Writ Appeal is disposed of. There shall be no order as to costs. 8. As a sequel, Miscellaneous Applications pending, if any, shall stand closed. _________________________________________ CHEEKATI MANAVENDRANATH ROY, J ________________________ TUHIN KUMAR GEDELA, J Date : 27-01-2026 BMS
