Heard the learned counsel appearing for the respective parties.
The petitioner is an accused in connection with POCSO Case 55 of 2025 arising out of Raidih P.S. Case No. 60 of 2025, pending in the Court of learned Additional Sessions Judge-IV-cum-Exclusive Special Judge, POCSO Court, Gumla.
The petitioner along with two of his passengers were trying to abduct the victim, but she resisted and jumped from the Auto suffering some injuries.
Submission has been advanced by the learned counsel for the petitioner that it was passengers in the vehicle who has been attributed to have molested the victim. It has been submitted that the petitioner is in custody since 05.09.2025 and the victim who has been examined as PW-1 has not specified any allegation against him.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
It appears that the petitioner was instrumental in facilitating the attempt at molestation made by the passengers of the vehicle and the injuries upon the victim reveal that she had suffered some injuries on the head.
Regard being had to the aforesaid facts, I am not inclined to grant bail to the petitioner. The same is hereby rejected at this stage.
