CWP-19686-2026 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 131 CWP-19686-2026 Date of decision : 03.07.2026 Shozab Raza ...... Petitioner versus State of Haryana and others ...... Respondents CORAM : HON'BLE MR. JUSTICE PANKAJ JAIN Present: Mr. Rajinder Sharma, Advocate for the petitioner. **** PANKAJ JAIN, J. (Oral)
1. Instant writ petition is directed against notice issued to the petitioner under Section 5 and 6 (2)(b) of the Haryana Evacuee Properties (Management and Disposal) Act, 2008 whereby the petitioner has been afforded an opportunity to show cause as to why he should not be evicted from the evacuee property. Admittedly, the petitioner has filed reply to the same which has been placed on record as Annexure P-13.
2. Counsel for the petitioner does not dispute that 2008 Act provides for statutory remedy in form of appeal under Section 7.
3. In view thereof, this Court finds that the present writ petition is misconceived. The apprehension raised by counsel for the petitioner with respect to forcible dispossession is also misplaced in view of the fact that show cause notice has been issued to the petitioner.
4. By filing reply, he has already submitted to the jurisdiction of the authority concerned.

5. In view of above, this Court finds no merit in the present writ petition. The same is dismissed. However, petitioner is granted liberty to raise all pleas before the concerned authority.
6. Ordered accordingly.
