Mr. Rajinder Kumar Banku, Sr. DAG, Haryana NNNN....SSSS....SSSSHHHHEEEEKKKKHHHHAAAAW W W WAAAATTTT,,,, JJJJ.... ((((OOOOrrrraaaallll)))) 1. The petitioner has filed the present petition under Section 528 of BNSS 2023, with a prayer to direct the respondent No. 2 to investigate the complaints of the petitioner and to register a case against respondent No.3, his wife and son, who have borrowed a sum of Rs. 14,15,000/- from the petitioner. 2. Learned counsel for the petitioner contends that respondent No. 3, Vinod Kumar, his wife and son, had already borrowed a sum of Rs. 14,15,000/- from the petitioner on different dates and now denied to return the same. When the petitioner allegedly went to them, they even threatened and abused him. Consequently, the petitioner moved an application to the SP Jind and prayed for action against the private respondents in this regard, but no action has been taken in the matter. On advance notice, Mr. Rajinder Kumar Banku, Sr. DAG, Haryana, has appeared on behalf of the official respondents and submits that the allegations levelled by the present petitioner constitute a civil dispute and no cognizable offence is made out in the present case. He further submits that since it was found to be a civil dispute between the parties, the complaints submitted by the petitioner have already been ordered to be filed by the police. 4. I have heard learned counsel for the parties and perused the record carefully. 5. From the allegations levelled by the petitioner in the complaint (Annexure P-2), it is apparent that the complaints regarding a civil dispute have been submitted to the police by the petitioner and the police can never be directed to investigate a civil matter. Apparently, from the complaint submitted by the petitioner, even no cognizable offence is made out against anyone and the petition is frivolous. 6. Finding no merits, the petition is ordered to be dismissed. 08.07.2026 ((((NNNN....SSSS....SSSSHHHHEEEEKKKKHHHHAAAAW W W WAAAATTTT)))) amit rana JJJJUUUUDDDDGGGGEEEE Whether reasoned/speaking : Yes/No Whether reportable : Yes/No AMIT RANA 2026.07.08 17:33 I attest to the accuracy and authenticity of this judgement/order
