The petitioner is anticipating arrest in connection with Dinhata Police Station Case No. 255 of 2026 dated 04.05.2026 under Sections 126(2) / 117(2) / 118(2) / 326(f) / 351(2) / 3(5) of the Bharatiya Nyaya Sanhita, 2023 corresponding to G.R. Case No. 279 of 2026 now pending before the learned Additional Chief Judicial Magistrate, Dinhata. 2. In support of the allegations made by the de facto complainant in the F.I.R. against the present petitioners and other accused persons, materials on record as regards deep-cut injury can be found through the injury 2 report in the case diary, though the same has not been mentioned as of any grievous nature. So far the allegation of setting the motorcycle on fire by the present petitioners are concerned, no such material is available in the case diary like recovery of any burnt motorcycle or its part etc. 3. Considering as above, I do not find the petitioners’ custodial interrogation to be absolute insofar as they cooperate with the investigation. 4. In view of the above, the petitioners’ prayer for anticipatory bail is allowed. 5. It is directed that in the event of arrest of the petitioners, the petitioners shall be granted bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Dinhata. The petitioners shall comply with the conditions under Section 482(2) of the BNSS, 2023 and shall cooperate with the investigation in all possible way. They shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever. 6. C.R.M.(A) 411 of 2026 stands disposed of. (Rai Chattopadhyay, J.) 3
