p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.7833 of 2026 Bhagaban Das and Ors. …. Petitioners Mr. P.R. Chhatoi, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 20.07.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Kakatpur P.S. Case No.84 of 2025 corresponding to G.R. Case No.398 of 2025 pending in the file of learned J.M.F.C., Kakatpur on the grounds stated. 3. Perused the FIRs as at Annexures-1 and 2. By not pressing the bail petition on merit, Mr. Chhatoi, learned counsel for the petitioners submits that the petitioner should be allowed to surrender before the learned court below seeking regular bail and in case of rejection to approach the Sessions Court pleading parity. State’s objection is noted down. The petitioners had earlier approached in ABLAPL No. 4917 of 2025 disposed of on 12th August, 2025. A copy of the said order is at Flag-B. Notwithstanding the earlier order, considering the submissions of learned counsel for the respective parties, the Court is p. 2 inclined to grant such liberty to the petitioners to surrender and seek regular bail before the Courts below. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the liberty in favour of the petitioners to surrender before the learned J.M.F.C., Kakatpur in connection with G.R. Case No.398 of 2025 corresponding to Kakatpur P.S. Case No.84 of 2025 within a fortnight from today and on an application moved by them, it shall be dealt with as per law and disposed of on the same day and in case of rejection, to approach the Sessions Court for orders on the same day and for the said purpose, the lower court record shall be made available at the time of hearing. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Balaram Designation: PERSONAL ASSISTANT
