1. The petitioners are apprehending arrest in connection with Mathabhanga Police Station Case No. 246 of 2026 dated 15.04.2026 registered under Sections 329(4) / 332(3) / 115(2)/117(2)/109/303(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

In view of the materials in record as well as in C.D it transpires that consecutive two criminal cases have been filed by the two groups, amongst whom there might have been some shuffling etc, being Mathabhanga Police Station Case No.246 of 2026 and Mathabhanga Police Station Case No.247 of 2026, on the same date.
3. C.D. in this case has revealed no grievous injury suffered by the victim. So far as the statement of the witnesses appearing in the CD is concerned, one or two of them
2 have supporting the allegations against the petitioners, but also there is no recovery of fire arms etc as alleged.
4. Therefore, fining no sufficient material for warranting custodial interrogation of the petitioners, the prayer of the petitioners for anticipatory bail is allowed with the following conditions.

It is directed that in the event of arrest of the petitioner, the petitioner shall be granted bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Mathabhanga. The petitioner shall comply with the condition under Section 482(2) of the BNSS, 2023 and shall cooperate with the investigation in all possible way. He shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever.
6. C.D. be returned.
7. C.R.M. (A) 373 of 2026 stands disposed of.
