This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 555/2024 registered at Police Station-Kotwali Ambikapur, District Surguja (C.G.) for the offence punishable under Section 420, 467, 468, 471, 120-B read with 34 of IPC. 2. The applicant had preferred a first bail applicant bearing MCRC No. 4761 of 2025 which was rejected on merit vide order dated 26.06.2025, thereafter, he preferred Second bail application for VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.02.10 17:27:13 +0530 2 granting regular bail. 3. Facts of the case are that, It is alleged by complainant namely Nazil that on 16.08.2024 employee of Hinduja Leyland Finance, Ambikapur has informed him that a vehicle i.e. Bullet has been financed by complainant from Hinduja Leylannd Finance, Ambikapur and he is not paying installment. When the complainant inquired the matter then it was found that on 23.11.2023, the applicant has misused his document and purchased vehicle from Victoria Automobile, Manendragarh, District Koria, Chhattisgarh in the name of complainant through finance. Based on aforesaid facts, present crime has been registered against the applicant and he has been arrested. Hence, this bail application. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present matter. He also submits that there are two criminal antecedent registred against the applicant bearing crime No.74 of 2024 registered at Police Station Rajpur, in which applicant is bail out and bearing crime No.124 of 2024 registered at Police Station -Chowki Kotba and same is pending. He also submits that there are total twenty prosecution, out of which only six prosecution witnesses have been examined and they have not supported the prosecution case. The applicant is in jail since 23.12.2024 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 5. On the other hand, learned State counsel opposes the bail application. 6. I have heard learned counsel for the parties and perused the case diary. 3 7. Taking into consideration the facts and circumstances of the case and also considering the fact that first bail application filed by the applicant was rejected on merit vide order dated 26.06.2025 in MCRC No. 4761 of 2025 which, further there appears to be no new ground.this Court is of the opinion that it is not a fit case to enlarge the applicant of bail. 8. Accordingly, the second bail application of the applicant- Shahrukh Khan involved in Crime No. 555/2024 registered at Police Station- Kotwali Ambikapur, District Surguja (C.G.) for the offence punishable under Section 420, 467, 468, 471, 120-B read with 34 of IPC. 9. However, this Court hopes and trusts that the trial Court shall make earnest endeavour to conclude the trial expeditiously, preferably within a period of six months from the date of passing of this order, if there is no legal impediment. 10.
