6 . This is an application for grant of permission to withdraw the amount deposited by the appellant.
2. The appellant had earlier deposited Rs.14,70,287/- on 10.12.2015 and this Court had vide order dated 28.04.2016 permitted the claimant to withdraw 50% of the said amount upon furnishing undertaking and balance 50% of the amount on furnishing solvent surety. Since the first appeal was dismissed by this Court vide judgment dated 30.04.2024, the appellant was
directed by this Court to deposit the enhanced amount of compensation within six months from 30.04.2024. The appellant has deposited the amount of Rs.42,98,368/- towards enhanced compensation on 07.01.2026. Hence, the respondent no.1 has filed this application for withdrawal of the said amount.
3. According to the counsel for the applicant/respondent no.1, the respondent no.1 is married and residing at Mumbai. She has executed the Special Power of Attorney in favour of her brother-Atul Dalpatbhai Mehta, in respect of withdrawal of the amount as well as verification process for withdrawal of the amount before this Court. 2026:BHC-NAG:7817

The applicant/respondent no.1 has also sought for a direction to the Registry of this Court to permit her brother, i.e. Power of Attorney holder, to identify as well as sign for and on her behalf on the basis of Special Power of Attorney executed by her in favour of her brother since she is ready to appear through video conferencing at the time of verification. It is also submitted that the amount so withdrawn shall be credited in the account of the respondent no.1.
5. Hence, for the reasons stated in the application, the same is allowed
in terms of Prayer Clauses (i), (ii) and (iii) of Civil Application (F) No.2424
of 2026 in First Appeal No.537 of 2015, decided by this Court on 30.04.2024. The civil application is disposed of in the aforesaid terms.
