JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking the following prayer: “WHEREFORE, the Petitioner most respectfully prays that this Hon'ble Court may be pleased to: i. Issue a Writ of Certiorari or any other appropriate writ, order, or direction, quashing the impugned order dated 11.02.2025 in WLOR.No.3 of 2024 on the file of the II Additional Chief Judicial Magistrate, produced herewith as ANNEXURE-A; ii. Issue a Writ of Mandamus or any other appropriate writ, order, or direction, directing the Respondent to release the vehicle bearing registration No. KA-53-D-9181, without insisting upon the furnishing of a bank guarantee, by considering the petitioner's application dated 03.04.2025, produced herewith as ANNEXURE-E; and iii. Pass such other and further orders or directions as this Hon'ble Court may deem fit, proper, and necessary in the facts and circumstances of the case, in the interest of justice and equity.” 2. The vehicle of the petitioner is intercepted and found that it was carrying elephant tusks. The petitioner claims that he is not the one who was carrying, but it is his brother. Therefore, his vehicle must be released. 3. The proceedings are pending before the competent Authority, where the petitioner has failed to appear. Therefore, the petitioner shall appear before the said Authority and submit an explanation with regard to the vehicle. The concerned Authority shall pass necessary orders after hearing the petitioner within a period of eight weeks of appearance of the petitioner in accordance with law.
