According to the prosecution story, on 03.01.2026, on receiving secret information, the police of Police Station Arang, District Raipur, after complying with the mandatory provisions of the NDPS Act, intercepted the vehicle bearing registration No. CG-04/ND-6040 at Village Lakhauli, near Old Toll Plaza. During search, from the joint possession of the Applicant and other co-accused persons, one packet containing 01 kilogram of contraband ganja and 75 bottles (total 7500 ml) of prohibited cough syrup containing Codeine Phosphate & Triprolidine Hydrochloride were allegedly seized from beneath the driver seat of the vehicle. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that the alleged contraband was not recovered from the exclusive possession of the Applicant but from the alleged joint possession of the Applicant and other co-accused persons. It is further submitted that the Applicant is in custody since 03.01.2026 and the trial is likely to take considerable time for its conclusion, therefore, he may be 3 enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the bail application and submits that the alleged seized quantity is above the commercial quantity. 5. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the fact that the alleged contraband seized was above commercial quantity and without further commenting anything on the merits of the case, this Court is not inclined to grant bail to the present Applicant 6. Accordingly, the bail application of the Applicant – Lekhu Sinha involved in Crime No.8/2026 registered at Police Station – Arang, District Raipur (C.G.), for the offences under Sections 21(C) & 20(B) of NDPS Act is hereby rejected. 7.
