Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner submitted that respondent No.3 is harassing the petitioner by interfering into her personal life and liberty, further barging in the petitioner’s house without any warrant or notice under the guise of FIR.No.66 of 2026 dated 12.05.2026 which was registered against husband of petitioner. 4. Learned Assistant Government Pleader for Home submitted the written instructions received from the Station House Officer, Repalle Police Station, wherein it is stated that the husband of the petitioner is involved in series of criminal cases registered on the file of Repalle Police Station and other police Station, the details of which are as follows: 4 1. Cr.No.49/2021 U/s 323, 506 r/w 34 IPC and 155(2) Cr.P.C of Repalle Police Station. 2. Cr.No.228/2025 U/s 125 BNS of Repalle Police Station. 3. Cr.No.235/2025 U/s 125 BNS of Repalle Police Station. 4. Cr.No.176/2025 of Bhattiprolu Police Station U/s 329(3), 324(4), 303(2) r/w 3(5) BNS. 5. Cr.No.04/2026 U/s 118(1) BNS of Repalle Police Station. 6. Cr.No.37/2026 U/s 189(3), 191(2), 126(2), 324(2), 352, 353(2), 132 r/w 190 BNS of Repalle Police Station. 7. Cr.No.66/2026 U/s 132, 329(1) r/w 3(5) BNS of Repalle Police Station. 8. Cr. No.71/2026 U/s 196(1), 352, 353(1) BNS and Section 67 of the Information Technology Act, 2000-2008, dated 23.05.2026 of Repalle Police Station. 5. Learned Assistant Government Pleader would further submit that in view of the continuous involvement of the petitioner’s husband in criminal activities affecting the maintenance of public peace and order, proceedings are initiated by way of opening rowdy sheet vide Proceedings No.11/SDPO- RLP/HS/2025 dated 15.05.2026 on the file of the Sub Divisional Police Officer, Repalle, against the petitioner’s husband. For the purpose of obtaining details as required under the Form-80, the police have called the petitioner’s husband and also to maintain a surveillance record. All the other allegations as alleged by the petitioner are denied by the police and specifically stated that the police 5 never compelled the petitioner or her father to sign any confession statements and threatened to implicate them in any criminal cases. 6. Recording the same, the Writ Petition is disposed of, directing the respondent-police to adhere to the procedure contemplated under the provisions of the BNSS, for taking any action against the husband of the petitioner without violating the fundamental rights of the writ petitioner as alleged in the writ affidavit. The petitioner is also directed to extend necessary cooperation for the purpose of providing required information to the police as required under the Form-80, if any. There shall be no order as to costs.
