JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court calling in question proceedings in C.C.No.30659/2024, pending before the 24th Additional Chief Metropolitan Magistrate at Bengaluru, registered for the offences punishable under Sections 498-A, 323, 504 read with Section 34 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Saravana S, learned counsel appearing for the petitioners, Smt.Waheeda M.M, learned HCGP appearing for respondent No.1, Smt.Sukanya V, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Memorandum of Settlement in M.C.No.849/2025 before the II Addl. Principal Family Judge, Bengaluru. The parties to - 4 - HC-KAR NC: 2026:KHC:34115 WP No. 30119 of 2024 the lis have also filed a Joint Memo before this Court in that regard. The said Memorandum of Settlement reads as follows: “MEMORANDUM OF SETTLEMENT UNDER S.89 OF CPC R/W RULES 24 & 25 OF KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES 2005 The petitioner and respondent above named beg to submit as under: I. The petitioner has filed the above petition against the respondent under Section.13 (1) (i-a) of the Hindu Marriage Act for dissolution of the marriage dated 12.02.2023 solemnized as per Hindu rites and customs at G V Mahal, No.122A, Tiruchangoodu Main Road, Pallipalayam, Erode, Tamil Nadu- 638006. II. The aforesaid case was referred to mediation for resolving the dispute between the parties. In the course of mediation, the parties who have been identified by their respective counsels along with their counsel have participated in the mediation process and they have resolved their dispute and have agreed to the following terms and conditions: 1. The petitioner and respondent are Hindus and were married on 12.02.2023 solemnized as per Hindu rites and customs at G V Mahal, No.122A, Tiruchamgoodu Main Road, Pallipalayam, Erode, Tamil Nadu-638006, Bangalore. 2. The petitioner and respondent have no children born to them from their wedlock. 3. That due to irreconcilable differences the petitioner and respondent have been unable to lead a marital life together and all efforts at reconciliation by family and well wishers have failed. The petitioner and respondent have been living separately since 2023. Without referring to, alluding to or admitting to the allegations made out in the - 5 - HC-KAR NC: 2026:KHC:34115 WP No. 30119 of 2024 petition and objections, the parties have agreed to mutually separate by way of divorce. 4. The petitioner has agreed to pay a total sum of Rs. 16,00,000/- (Rupees Sixteen Lakhs only) towards marriage expenses in full and final settlement of all claims of the respondent by way of demand draft bearing No.030843 dated 09.06.2026 draw on Axis Bank, Chamarajpet Branch, Bengaluru in favour of respondent. The said D.D will be handed over to the respondent at the time of reporting settlement before the Hon'ble Court. 5. The petitioner and respondent have already exchanged their respective belongings. 6. The respondent has filed a petition under domestic Violence Act, bearing Crl Misc No.235/2024 pending before the MMTC-II, Bengaluru. The respondent has also filed a complaint bearing Crime No.61/2024 which has culminated to C.C No.30659/2024 pending before 24th ACMM, Bengaluru. The petitioner has questioned the same in WP No.30119/2024 before the Hon'ble High Court of Karnataka, Bengaluru. The respondent has agreed to withdraw the petition before MMTC-II, Bengaluru and has no objections in W P No.30119/2024 being allowed. 7. That they have no claims of any nature whatsoever be it past, present or future against each other in respect of maintenance/permanent alimony against each or in respect of the moveable or immoveable properties of each other - existing, inherited or to be acquired in the future except to the extent mentioned herein. 8. The petitioner and respondent shall not interfere in the lives of each other or their families in any manner of form in future. III. In view of the aforesaid agreement entered into between the Petitioner and the Respondent, the parties pray that the marriage dated 12.02.2023 solemnized as per Hindu rites and customs at G V Mahal, No.122A, - 6 - HC-KAR NC: 2026:KHC:34115 WP No. 30119 of 2024 Tiruchangoodu Main Road, Pallipalayam, Erode, Tamil Nadu-638006, be dissolved by a decree of divorce, in terms of the aforesaid agreement. IV. Parties to appear before the Court on 11.06.2026 for passing orders in terms of the Agreement.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Memorandum of Settlement being filed before the Family Court as quoted supra and also the joint memo being filed by the parties to the lis and offences not being against the State, I deem it appropriate to accept the said Memorandum of Settlement and also the Joint Memo and terminate the proceedings against the petitioners in the subject petition. 6.
