1. The petitioners have filed this petition seeking the following relief(s):-
“10.1 The Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case from possession of the respondents for its kind perusal. 10.2 The Hon’ble Court may kindly be pleased to issue a suitable writ/order/direction the respondent authorities to stop illegal deduction some part of salary and return the amount already deduction illegally. 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit.”

Learned counsel appearing for the petitioners would submit that earlier petitioners were working as Shikshakarmis with the Panchayat Department and thereafter they participated in the examination for the post of Teachers conducted by the Chhattisgarh VYAPAM after obtaining due permission from earlier employer. He would contend that the petitioner were selected and subsequently appointed to the post of Teachers. He would submit that initially the petitioners were getting full pay scale, subsequently their pay scales were reduced without assigning any reason. He would contend that the petitioners are entitled for pay protection according to the provisions Rule 22-B of Fundamental Rules. He would submit that the issue involved in the present case is no more res integra and the High Court in WPS No. 6436/2021 directed the respondent authorities to extend benefit of pay protection. He would contend that the petitioners may be permitted to make representation(s) before the respondent No. 2 and in turn, the said authority may be directed to decide representation(s) made by the
3 petitioner expeditiously strictly in accordance with law within stipulated time. 3. On the other hand, learned Panel Lawyer appearing for the State/respondents would oppose. He would submit that the petitioners have not challenged the circulars/orders issued by the State from time to time. It is also contended that the petitioners have not claimed relief of pay protection in the instant writ petition. He would submit that this petition deserves to be dismissed. 4. I have heard learned counsel for the the parties and perused the documents. 5. Perusal of the pleadings made in the writ petition would reveal that impliedly the petitioners have claimed pay protection according to the provisions of Rule 22-B of the Fundamental Rules. The issue has already been considered and decided in the matter of Amrit Lal Sahu & Ors. v. State of Chhattisgarh & Ors. passed in WPS No. 6436/2021 dated 19.11.2023. 6. Having considered the above stated facts, the petitioners are permitted to make detailed representation(s) before the respondent No. 2 within a period of 30 days and in turn, the said authority is directed to decide the representation(s) so made by the petitioners strictly in accordance with law keeping in mind the judgment passed in WPS No. 6436/2021 (Amrit Lal Sahu & Ors.
v. State of Chhattisgarh & Ors.) preferably within a period of 90 days from the date of receipt of copy of this order. 7. With the aforesaid directions, this writ petition is disposed of. Sd/-
