Chief Judicial Magistrate, Bengaluru, for the offences under Sections 115(2), 351(2), 352 read with Section 3(5) of BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri.Mohammed Pasha C, learned counsel appearing for the petitioners, Smt.Waheeda M.M, learned HCGP appearing for respondent No.1, Sri.Mohammed Arshad, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit in that regard. Shafiullah, Aged about 26 years, R/at Ward No.19, Near Mosque, Mehaboob Nagara, Ramanagaram, Ramanagara, Karnataka - 562159.(First Party/Petitioner No.1). Today at Bengaluru, I do hereby solemnly affirm and state an oath as follows on behalf of me with petitioner no.2 & 3. I, Smt. Iman, W/o. Saqib Pasha, Aged about 20 years, R/at No.30, 16th Cross, Near Karnataka Medical, Iliyas Nagar, Bengaluru City, Karnataka - 560078.(Second Party/Respondent No.2). Today at Bengaluru, I do hereby solemnly affirm and state an oath as follows. 1. We are Petitioner Nos.1 to 3 and Respondent No.2/Defacto Complainant respectively in the above case. We are well acquainted with the facts and circumstances of the case and are competent to swear to this Joint Affidavit. 2. We state that, the averments made in the memorandum of petition may be treated as part and parcel of this affidavit in order to avoid brevity and circumlocution. 3. We state that, the above Criminal Petition has been filed under Section 528 of the BNSS, 2023 seeking quashing of the Complaint and FIR in Crime No.53/2026 registered by West Women Police Station, Bengaluru City, for the offences punishable under Sections 85, 115(2), 351(2), 352 R/w 3(5) of the BNS, 2023 and sections 3 & 4 of the Dowry Prohibition Act, 1961, which is pending before the Hon'ble XXIV Additional Chief Judicial Magistrate, Bengaluru City. 4. We state that, with the intervention of our elders, family members, relatives and well-wishers, all the disputes and misunderstandings which had arisen between us have now been amicably settled. We have resolved all our differences voluntarily and have decided to bring an end to all the disputes between us in a peaceful and dignified manner. 5. We further state that the settlement has been arrived at voluntarily, out of our own free will and volition, without any force, coercion, undue influence, threat or pressure from any person whatsoever. - 5 - HC-KAR NC: 2026:KHC:34124 CRL.P No. 9774 of 2026 6. The Second Party/Respondent No.2 categorically states that she has no objection whatsoever for quashing the Complaint and FIR in Crime No.53/2026 registered by West Women Police Station, Bengaluru City, for the offences punishable under Sections 85, 115(2), 351(2), 352 R/w 3(5) of the BNS, 2023 and sections 3 & 4 of the Dowry Prohibition Act, 1961, together with all consequential proceedings pending before the Hon'ble XXIV Additional Chief Judicial Magistrate, Bengaluru City. She further states that she does not intend to prosecute the matter any further. 7. We further state that, in view of the amicable settlement arrived at between us; no useful purpose would be served by continuing the criminal proceedings. We have no surviving grievance or claim against each other in respect of the subject matter of the present complaint. WHEREFORE, we most respectfully pray that this Hon'ble Court may be pleased to accept this Joint Affidavit and be pleased to allow the Criminal Petition by quashing the Complaint and FIR in Crime No.53/2026 registered by West Women Police Station, Bengaluru City, for the offences punishable under Sections 85, 115(2), 351(2), 352 R/w 3(5) of the BNS, 2023 and sections 3 & 4 of the Dowry Prohibition Act, 1961, pending before the Hon'ble XXIV Additional Chief Judicial Magistrate, Bengaluru City, in the interest of justice and equity.
