IN THE HIGH COURT AT CALCUTTA Circuit Bench at Jalpaiguri
08.07.2026 Item No. 1(SL) Ct. No. 5 CRM(A)/387/2026 S.De In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, corresponding to under Section 438 of Code of Criminal Procedure.
In the matter of : KOUSHIK SINGHA ROY … Petitioner.
Ms. Srishti Sarkar …for the Petitioner.
Mr. Avrojyoti Das, ld. APP
…for the State.
1. The matter has come up in the list for clarification due to the fact that no affidavit of service, showing service upon the de facto complainant, could be found on record.
2. Learned advocate for the petitioner has submitted that due to the fact that the service could not have been completed upon the de facto complainant, the Court
directed for service through the state machinery.
3. Mr. Das, learned APP, submits that endorsement as regards completed service upon the de facto complainant is available with him, though could not have been placed before the Court on the last date of hearing, due to some unavoidable reasons.
4. Today, both of the learned advocates for the petitioner as well as the State are present and willing to produce before
2 the Court the affidavit and or proof of service having been completed already.
5. However, it is found prudent that let the matter be placed before the next Circuit Bench for further
consideration when learned respective advocates may submit whatever relevant documents are available with them.
