1. The present writ petition has been filed by the petitioners challenging
order dated 18.11.2025 passed by the learned Central Administrative Tribunal, Jammu Bench (for short the Tribunal) in TA bearing No. 8334 of 2021, titled, Sandhya Bakshi vs. State of J&K and others.

Learned counsel appearing for the petitioner submits that there is no adjudication of the entitlement of the respondent for a higher non gazetted post of teacher and without assigning any reason, whatsoever, the TA preferred by the respondent has been allowed.
3. Notice. Notice waived by Ms. Anjana Rana, learned counsel appearing on behalf of the respondent. Caveat shall stand discharged.
4. Ms. Shivani Jalali, learned senior counsel appearing for the respondent, fairly submitted that the matter be remitted to the learned Tribunal as 16

there is no adjudication by the learned Tribunal. She further submits that the petitioner No. 1, despite repeated opportunities, did not respond to the application preferred by the respondent. She also submitted that while remitting the matter to the learned Tribunal, the petitioner No. 1 be directed to respond to the application preferred by the respondent.
5. In view of the above, the present writ petition is allowed. Order dated 18.11.2025 passed by the Tribunal in TA bearing No. 8334 of 2021, titled, Sandhya Bakshi vs. State of J&K and others, is set aside. The petitioner No. 1 is granted last and final opportunity to file response before the learned Tribunal in the TA supra and in case, the response is not filed by petitioner No. 1, learned Tribunal may resort to coercive measures so as to ensure that the matter is adjudicated on merits.
6. As the matter is quite old, we are sanguine that the learned Tribunal shall endeavour to decide the TA, remitted to it, as expeditiously as possible, preferably within a period of three months from the date a copy of this order is made available in the office of the Tribunal.
7. The parties shall appear before the learned Tribunal on 10.09.2026.
