JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners – accused Nos.1 to 4 are before this Court calling in question proceedings in C.C.No.59448/2025 (arising out of Crime No.56/2024), pending before the 29th Additional Chief Metropolitan Magistrate Court, Mayohall, Bengaluru, for the offences punishable under Sections 85, 352, 3(5) of the BNS and Sections 3 and 4 of the Dowry Prohibition Act, 1961. - 4 - HC-KAR NC: 2026:KHC:31651 CRL.P No. 10725 of 2025 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the family Court in M.C.No.2237/2026 and during the pendency of the subject proceedings, they have settled their matrimonial dispute amicably by drawing up certain terms and conditions before the mediation center and have parted their ways. The parties seek permission to compound the offences by filing a joint memo and a certified copy of memorandum of settlement under Section 89 of the CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rule, 2005 before this Court. 3. Learned counsel for petitioners hands over a demand draft of Rs.3.50/- lakhs to respondent No.2 – complainant and the same is acknowledged by respondent No.2 – complainant, who is present before the Court. 4. The joint memo and memorandum of settlement read as follows: “JOINT MEMO The Petitioners and Respondent in the above case respectfully submit as follows: - 5 - HC-KAR NC: 2026:KHC:31651 CRL.P No. 10725 of 2025 1. That the 1st Petitioner and Respondent No.1 have amicably settled the dispute between themselves and entered into a memorandum of settlement dated 30.04.2026, before the Karnataka Mediation Centre, Bengaluru. A certified copy of the Memorandum of settlement dated 30.04.2026 entered between the parties is herewith produced for the kind perusal of this Hon'ble Court. 2. That in furtherance of the above settlement, marriage solemnized with the 1st Petitioner and 1st Respondent was dissolved by granting decree of divorce by mutual consent in M.C.No.2237/2026. A certified copy of the Decree of Divorce dated 02.05.2026 is herewith produced for the kind perusal of this Hon'ble Court. 3. That as per the settlement, the 1st Petitioner herewith paying balance amount of Rs.3,50,000/- (Rupees Three Lakh Fifty Thousand only) in favour of Respondent No.1 vide DD No. 273720, dated 23.06.2026, drawn on State Bank of India, Siruguppa Branch. 4. That in view of the settlement arrived between the parties, both the parties hereby unconditionally withdraw the allegations made against each other. 5. That both parties hereby undertake that they will not make any allegation in future against each other and further undertake that they will not interfere with each other's life in future. 6. That in view of the settlement arrived between the parties, the Respondent No.1 hereby voluntarily, without any force or coercion, withdraw the complaint lodged by her against the Petitioners herein in Crime No.56/2024. Further she has no objection to quash the entire proceedings pending in S.C.No.275/2026, pending on the file of XLV City Civil and Sessions Judge, Bengaluru. Hence this Joint Memo.” ………….. - 6 - HC-KAR NC: 2026:KHC:31651 CRL.P No. 10725 of 2025 “MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. The parties above named submit as follows:- I. The petitioners have filed the above joint petition under Section 13-B of the Hindu Marriage Act, 1955 for dissolution of their marriage by a decree divorce by mutual consent. The statutory period of six months has been waived off by the Hon'ble court vide its order dated 07.04.2026. II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. In the course of mediation, the petitioners with their counsel were present, identified each other and they have resolved their dispute and have agreed to the following terms and conditions: 1. The petitioners state their marriage was solemnized on 15.05.2022 at Sri Kammavari Kalyana Mantapa, Bellary Road, Siruguppa, Bellary District, as per Hindu rites and customs. The 1st petitioner is residing at Bengaluru within the jurisdiction of this Hon'ble Court. 2. Due to irreconcilable differences and incompatibility of temperaments, the petitioners have been separated from January 2024. The efforts made by the elders, friends and well- wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of reunion amongst them. Hence, the petitioners have decided to get the marriage between themselves dissolved by a decree of divorce mutually. 3. Both the parties state that they have no children born to them from their wedlock. 4. The 2nd petitioner has agreed to pay a sum Rs.7,50,000/- (Rupees Seven Lakhs Fifty Thousand Only) to the 1st petitioner towards - 7 - HC-KAR NC: 2026:KHC:31651 CRL.P No. 10725 of 2025 maintenance/permanent alimony as full and final settlement of all her claims. out of agreed amount the 2nd petitioner has agreed to pay an amount of Rs.4,00,000/- (Rupees Four Lakhs Only) by way of demand draft bearing No.273212 dated 09.02.2026 drawn on State Bank of India, Siruguppa Branch, and the same will be handed over to the 1st petitioner at the time of reporting settlement of the above case before this Hon'ble Court. The balance amount of Rs.3,50,000/- (Rupees Three Lakhs Fifty Thousand Only) will be paid by way of demand draft before the Hon'ble High Court of Karnataka in Crl P No.10725/2025 at the time of closure/quashing of the SC No.275/2026 on the file of the 45th Addl. City Civil and Sessions Judge, Bengaluru for the offences punishable under Section 85, 89, 352, 3 (5) of BNS and r/w Section 3 & 4 of DP Act. The 1st petitioner has agreed to receive the same. In view of the settlement arrived between the parties the 1st petitioner undertakes to cooperate with the 2nd petitioner for quashing of the Crl Misc No.03/2025 filed under Section 12 of D VA Act, pending before V MMTC, Bengaluru in Crl P No.395/2026 before the Hon'ble High Court of Karnataka, Bengaluru. 5. Both the petitioners state that they have already exchanged their respective valuable articles and other Personal belongings. 6. The petitioners state and agree that they have no other claims of whatsoever against each other either for the past, present and future. 7. The petitioners further state that they have no claims of whatsoever over the movable or immovable properties belonging to each other either existing or to be acquired. 8. Both the petitioners state that they have no other case/complaints pending between them before any Court/Authority. - 8 - HC-KAR NC: 2026:KHC:31651 CRL.P No. 10725 of 2025 9. The petitioners further state that there has been no collusion or force, fraud or any undue influence in entering into this settlement agreement in the aforesaid manner. 10. Both the parties admit that they shall not interfere in the lives of each other in future. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized between the petitioners on 15.05.2022 at Sri Kammavari Kalyana Mantapa, Bellary Road, Siruguppa, Bellary District, by granting a decree of Divorce in terms of the aforesaid agreement. IV. Parties will appear on 30.04.2026 before the Hon'ble Court for passing orders in terms of the agreement.” In the light of then afore-quoted joint memo and the memorandum of settlement, that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the terms as afore-quoted and terminate the proceedings against the petitioners, as the allegations are not against the State. 5. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.59448/2025 (arising out of Crime No.56/2024), pending before the 29th - 9 - HC-KAR NC: 2026:KHC:31651 CRL.P No. 10725 of 2025 Additional Chief Metropolitan Magistrate Court, Mayohall, Bengaluru, stand quashed.
