Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor, Assam. By this application filed under Section 528 of the BNSS, 2023 the petitioner Helal Uddin has challenged the order dated 09.02.2026 passed by the learned Special Judge (FTC), Sribhumi in Special (NDPS) Case No. 02/2026. One vehicle bearing Registration No. ML-06A-1649 was seized by Police. The petition Page No.# 2/2 filed by the petitioner before the learned Trial Court seeking zimma of the said vehicle was rejected by the court below. I have considered the submission made by the learned counsel for both sides. This Court is of the opinion that keeping the vehicle in custody will not serve any purpose. Therefore, prayer of the petitioner seeking custody of the vehicle aforesaid is allowed. The impugned order dated 09.02.2026 passed by the learned Special Judge (FTC), Sribhumi in Special (NDPS) Case No. 02/2026 is set aside and quashed. It is hereby directed that the vehicle bearing Registration No. ML-06A-1649 which was seized by Police shall be given in custody of the registered owner after proper verification and identification on taking a bond of Rs.2,00,000/- (Rupees Two Lakhs).
