JUSTICE M.NAGAPRASANNA ORAL ORDER In Crl.P.Nos.12920/2023, 5432/2022 and 6633/2025, petitioners – accused Nos.1, 5 and 4 respectively, are before this Court calling in question proceedings in C.C.No.675/2021, pending before the Civil Judge and JMFC, Arkalagud, for offences punishable under Sections 498A, 323, 504, 506, 114, 354, r/w. 149 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. In Crl.P.No.6766/2023, petitioners – accused Nos.1 and 3 are before this Court calling in question proceedings in C.C.No.343/2021, pending before the Civil Judge and JMFC, Arkalagud, for offences punishable under Sections 323, 354, 504, 506 r/w. 34 of the IPC. - 8 - HC-KAR NC: 2026:KHC:27707 CRL.P No. 12920 of 2023 C/W CRL.P No. 5432 of 2022 CRL.P No. 6766 of 2023 AND 1 OTHER 2. Learned counsel for the petitioners – accused and respondent No.2 – complainant, in all the petitions, in unison would submit that the parties to the lis were before the concerned family Court and during the pendency of these petitions, they have settled their matrimonial dispute amicably by drawing up certain terms and conditions. They have parted their ways and have filed memorandum of compromise petition under Section 320 r/w. 397 of the Cr.P.C. along with separate affidavits of the parties seeking permission to compound the offences before this Court. 3. The memorandum of compromise petition reads as follows: “1. The Petitioner in Crl. P. No. 12920/2023 herein and Respondent No.2 are the husband and wife and there are no children born out of the wedlock. The Petitioners in Crl. P No. 5432/2022 Crl. P No. 6766/2023 and Crl. P No. 6633/2025 are in-laws of Respondent No.2 in respective petitions. 2. It is submitted that, the Petitioners and Respondent No.2 in Crl. P No. 12920/2023, Crl. P No. 5432/2022 Crl. P No. 6766/2023 and Crl. P No. 6633/2025 submits that, they have entered into compromise in MC No.26/2026 on the file of Senior Civil Judge, Araklgudu, by way of filing application u/s 13(b) of Hindu Marriage Act for mutual consent, without any undue influence or coercion and have amicably settled the matter of their own free will by arriving into following terms and condition. It is submitted that, Respondent no.2 herein has filed cases in Arakalagud JMFC Court in CC No. 675/2021 and CC No.343/2023. Now, by the intervention - 9 - HC-KAR NC: 2026:KHC:27707 CRL.P No. 12920 of 2023 C/W CRL.P No. 5432 of 2022 CRL.P No. 6766 of 2023 AND 1 OTHER and advice of well-wishers and elderly members of respective families. It is agreed by Respondent No.2 that 15,00,000/- to be paid by the Petitioners herein as the permanent alimony to be paid in part before respective courts as per the settlement terms mentioned in the divorce petition filed by way of mutual consent. 3. The Respondent No.2 herein has agreed to withdraw the following cases namely, CC no.675/2021 and CC No. 343/2023 pending on the file of Arakalagud JMFC Court and has no objection for allowing the Crl. P No. 5432/2022, Crl. P No. 6766/2023 and Crl. P No. 5369/2021 pending before this Hon'ble Court. Further in Crl. P No. 12920/2023, Crl. P No. 6633/2025 Pending before this Hon'ble Court. 4. It is submitted that, Respondent No.2 herein agreed to withdraw the following cases in Crl. Misc. No. 45/2021, Crl. Misc. No. 117/2024, Crl. Misc. No. 347/2025 and Crl. Misc. No. 397/2023. 5. Further it is submitted that, the Petitioners and Respondent No.2 in the above Criminal Petition have settled their inter-say misunderstanding and dispute with the intervention and advice of well-wishers and elderly members of their respective families. The parties have settled their dispute amicably and they no longer intend to pursue the above Criminal Petition. Respondent No.2 is present before this Hon'ble Court and has filed an affidavit in support of this compromise petition, request and gives her no objection for allowing these petitions. 6. The Petitioner has agreed to pay sum of Rs. 15,00,000/- (Rupees fifteen lakhs only) to Respondent no.2 as permanent alimony. Upon receipt of the said amount, Respondent no.2 shall have no claims whatsoever against the Petitioner in respect of any movable, immovable or other property, nor any kind of claim in the future. Out of the said permanent alimony, a sum of Rs. 2,00,000/-(Rupees Two Lakhs Only) already paid on 15.04.2026 before V Additional District and Sessions Judge, Hasan in Criminal Revision Petition No. 54/2025, at the time of submitting the compromise memo. Copy of the order sheet in CriR.P No.54/2025 is produced herewith and marked as DOCUMENT No.1. The said payment was made by the Petitioner to Respondent no.2 through Demand Draft. The remaining - 10 - HC-KAR NC: 2026:KHC:27707 CRL.P No. 12920 of 2023 C/W CRL.P No. 5432 of 2022 CRL.P No. 6766 of 2023 AND 1 OTHER amount of Rs. 13,00,000/-(Thirteen lakh rupees) will be paid at the time of closing mutual consent divorce petition filed by the parties. 7. It is submitted that, the above criminal petition is been amicably settled as per the application filed in MC No.26/2026 for mutual consent. Copy of the MC petition is produced herewith and marked as DOCUMENT No.2. As per the compromise memo filed in MC No. 26/2026, the petitioner is handing over the Demand draft bearing BC No. 51517515 drawn on Union bank in favour of Sangeetha H for the amount of Rs. 13,00,000/- on 23/04/2026. 8. The ID proof of the Petitioner and De-facto Complainant is produced along with this memorandum of compromise petition. The same may be kindly taken on record.” In the light of the afore-quoted memorandum of compromise petition, I deem it appropriate to terminate the proceedings against the petitioners in all the petitions, as it is a matrimonial dispute and the allegations are not against the State. 4.
