JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused in S.C.No.9/2026 pending before the Court of I Addl. District and Sessions Judge, Bengaluru Rural District, Bengaluru, arising out of Crime No.443/2025 registered by Varthur Police Station, Bengaluru City, for offences punishable under Section 103 of BNS, 2023, is before this Court in this criminal petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.443/2025 was registered by Varthur Police Station, Bengaluru, for the aforesaid offence against the petitioner herein based on the first information dated 28.08.2025 received from Bijendra Singh, uncle of the deceased Smt.Poonam Singh. In the said case, petitioner, who is the husband of the deceased, was arrested on 28.08.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed - 3 - HC-KAR NC: 2026:KHC:34247 CRL.P No. 5843 of 2026 against the petitioner for the aforesaid offence. His bail application filed before the Trial Court in Crl.Misc.No.408/2026 was rejected on 01.04.2026. Therefore, he is before this Court. 4. Perusal of the first information dated 28.08.2025 reveals that marriage of the petitioner with Poonam Singh, niece of the first informant, was solemnized in the year 2020 and from the said wedlock, they have two children. About 3 years prior to the alleged incident, petitioner along with his family members had come to Bangalore and he was working as a Carpenter. It is alleged that the petitioner was in the habit of consuming alcohol and abusing his wife. On 28.08.2025 at about 11.30 a.m., first informant was informed by his relative that petitioner had assaulted his wife and had committed her murder. The first informant thereafter came to the house of the petitioner and after seeing the dead body of deceased Poonam Singh, he had approached the Police and submitted his first - 4 - HC-KAR NC: 2026:KHC:34247 CRL.P No. 5843 of 2026 information, based on which FIR was registered against the petitioner. 5. During the course of investigation, petitioner was arrested on 28.08.2025 and remanded to judicial custody. The charge sheet material would reveal that on 28.08.2025, after the dead body was shifted to the hospital, the police had given history that the deceased was found hanging on 28.08.2025 at around 11 a.m. in her residence at Dommasandra, Varthur. The doctor in the hospital had declared that Poonam Singh was brought dead. Post mortem report of the deceased would suggest that her hyoid bone and thyroid cartilage were found to be intact. 6. Allegation as against the petitioner in the charge sheet is that on 28.08.2025, after consuming alcohol, at about 09.00 a.m., he had quarreled with his wife, Poonam Singh and also had assaulted her with his hands. Subsequently, with the help of a nylon rope, he allegedly strangulated her to death. - 5 - HC-KAR NC: 2026:KHC:34247 CRL.P No. 5843 of 2026 7. The injuries found on the dead body of the deceased would suggest that petitioner had assaulted the deceased prior to her death. Charge sheet material would go to show that even the petitioner had suffered certain injuries on his body. However, the history given by the police to the hospital after the dead body of Poonam Singh was shifted and also the post mortem report of the deceased, would raise a question whether the death was homicidal or suicidal. 8. The petitioner has no other criminal antecedents and is required to take care of his two minor children. He has undertaken to abide by the conditions that may be imposed on him by this Court and also to cooperate before the Trial Court. 9. I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. The petitioner is directed to be enlarged on bail in S.C.No.9/2026 pending before the Court of I Addl. District and Sessions Judge, Bengaluru Rural District, Bengaluru, arising out of Crime No.443/2025 registered by Varthur Police Station, Bengaluru City, for offences punishable under Section 103 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 7 - HC-KAR NC: 2026:KHC:34247 CRL.P No. 5843 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
