Neutral Citation No. (2026:JHHC:28460) IN THE HIGH COURT OF JHARKHAND AT RANCHI Criminal Revision No. 708 of 2026 --- Rohan Lakra .... Petitioner Versus The State of Jharkhand … Opposite Party --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioner : Mr. Rajesh Kumar, Advocate For the State : Mrs. Kumari Rashmi, APP --- Order No. 03 Dated 21st September, 2026 Heard the learned counsel for the respective sides. This application is directed against the judgment dated 20.05.2026 passed by the learned Additional Sessions Judge-I-cum-Special Judge, Children Court, Latehar in Criminal Appeal No. 41 of 2026, whereby and whereunder, the order dated 23.04.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Latehar in connection with Netarhat P.S. No. 01 of 2026, rejecting the prayer for bail of the petitioner, has been affirmed. It has been submitted that by the learned counsel for the petitioner that so far as the merits of the case are concerned, it is apparent that the allegations are general and omnibus in nature. Learned counsel submits that the social investigation report is not adverse to the cause of the petitioner and the petitioner is in remand home since 30.01.2026. It has further been submitted that the father of the petitioner shall ensure the safe keep of the petitioner. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner. It appears from the First Information Report that the cousin of the informant was assaulted by the petitioner and other accused persons and ultimately, he succumbed to his injuries on the next day. The allegation thus seems to be general and omnibus in nature so far as the petitioner is concerned. The Social Investigation report reveals that due to lack of proper parental care and social backwardness, delinquency may develop in the petitioner. However, considering the fact that the petitioner is in observation home since 30.01.2026 and the Social Investigation report is not to such an extent which would indicate that the release of the petitioner would lead him to physical and phycological danger, while setting aside the judgment dated 20.05.2026 passed by the learned Additional Sessions Judge-I-cum-Special Judge, Children Court, Latehar in Criminal Appeal No. 41 of 2026 and the order dated 23.04.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Latehar in connection with Netarhat P.S. No. 01 of 2026, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Latehar in connection with Netarhat P.S. No. 01 of 2026, subject to the condition that the father of the petitioner shall ensure the safe keep of the petitioner and shall also ensure that the petitioner is not allowed to mingle with any antisocial elements. This application stands allowed. (Rongon Mukhopadhyay, J) 21.09.2026 MK Page-2
