1. Heard learned counsel for the applicant and learned counsel for the State. 2. The applicant-lady, who is in custody since 31.10.2025, has approached this Court for grant of regular bail in connection with S.T. No.269 of 2025, arising out of Meharma P.S. Case No.78 of 2025, registered for the offence under Sections 191(2)/ 191(3)/ 190/ 115(2)/ 126(2)/ 117(2)/ 109/ 303(2)/ 74/ 352/ 351(2)/ 351(3)/ 79/ 62 of the BNS, 2023. 3. It has been submitted by the learned counsel for the applicant that complete set of F.I.R along with its enclosures have been annexed with the present bail application and there is no suppression on his/ her part. Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. It has been submitted that it was a simple scuffle and some of the co- accused have been granted anticipatory bail by the Co-ordinate Benches of this Court vide orders dated 25.11.2025 & 18.12.2025, passed in A.B.A Nos.6642 of 2025 & 7241 of 2025 and some of the co-accused have been granted regular bail. It has further been submitted that allegation of attempted rape is an agenda because it was in public place and the mob was there. On the above basis, prayer for bail has been made. 4. On the other hand, learned counsel for the State has opposed the prayer for bail. 5. Considering the fact that the applicant is a lady and the period of custody, I am inclined to enlarge the applicant on bail.
Accordingly, the applicant is directed to be released on bail, on - 1 - B.A. No.443 of 2026
2026:JHHC:5509 her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge – III, Godda, in connection with S.T. No.269 of 2025, arising out of Meharma P.S. Case No.78 of 2025, on the condition that the applicant will submit self-attested photocopy of her Aadhaar Card and also submit her mobile number before the learned trial court which she will always keep active and will not change it during pendency of this case without prior permission of the court.
