JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court calling in question proceedings in C.C.No.1285/2021, pending before the XI ACJM, Mayohall at Bengaluru, for the offences under Sections 498-A, 323 read with Section 34 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. - 3 - HC-KAR NC: 2026:KHC:34118 CRL.P No. 1305 of 2026 2. Heard Sri.Rangaswamy M.T, learned counsel appearing for the petitioners, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.Shivakumarappa T.C., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint memo of compromise in that regard. The joint memo of compromise reads as follows: “1. The marriage between the first petitioner and the second respondent was solemnized on 20-06-2019. 2. due matrimonial disputes the respondent No.2 lodged a complaint and Crime.No.81/2020 was registered against the petitioners for the offences punishable under Sections 498(a), 323, R/w 34 of IPC and Under Sections 3 & 4 of the D.P.Act. 3. The petitioners and the second respondent submits that subsequently with the intervention of the elders and well wishers the parties have amicably settled all their disputes voluntarily and without any force coercion or under influence and mediation agreement also made in O.S No.16/2023 pending on the file of family court at Bangalore. 4. The petitioner No.1 and the second respondent have agreed to live separately by obtain divorce by mutual consent; the entire settlement/permanent alimony has been agreed to pay as per the settlement agreed in mediation agreement. - 4 - HC-KAR NC: 2026:KHC:34118 CRL.P No. 1305 of 2026 5. The respondent No.2 has no objection to quashing the criminal proceedings pending in CC.No.1285/2021 arising out of Crime. No.81/2020. 6. The parties undertake to abide by the terms of settlement arrived between them, the settlement also include payment of permanent alimony of Rs.5,00,000/- (Rupees five Lakhs) as well as mutual consent divorce between petitioner No.1 and respondent No.2. The compromise is genuine and in the interest of justice. 7. The parties respectfully submit that continuation of the proceedings would serve no useful purpose and would amount to abuse of process of law. PRAYER Wherefore the petitioners and respondent No.2 most respectfully pray that this Hon'ble Court be pleased may be pleased to a) Record this Memorandum of compromise. b) Allow the criminal petition and c) Quash the FIR, charges sheet and all further proceedings in CC No.1285/2021 pending before the XXXII ACJM at Bangalore.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of the joint memo of compromise being filed by the parties to the lis and offences not being against the State, I deem it appropriate to accept the joint memo of compromise and terminate the proceedings against the petitioners in the subject petition. - 5 - HC-KAR NC: 2026:KHC:34118 CRL.P No. 1305 of 2026 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed.
