JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners call in question the proceedings in C.C.No.1933/2026 registered for an offence punishable under Sections 85, 115(2), 351(2), 352 read with Section 190 of the Bharatiya Nyaya Sanhita (BNS), 2023. - 4 - HC-KAR NC: 2026:KHC:33726 CRL.P No. 8708 of 2026 2. Heard Sri. Divyabhusha S.P., learned counsel appearing for the petitioners and Smt. Waheeda M.M., learned High Court Government Pleader appearing for respondent No.1 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have settled the dispute amongst themselves before the Family Court and the memorandum of agreement reads as follows: “MEMORANDUM OF AGREEMENT UNDER SECTION 89 OF THE CODE OF CIVIL PROCEDURE READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2007. The above named parties submit as follows:- 1. The petitioners have filed this joint petition under Section 13 (B) of the Hindu Marriage Act, 1955 for dissolution of their marriage by mutual consent. II. The Hon'ble Court has waived off the cooling period of six months vide its order dated 08.04.2026. III. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of mediation, both the petitioners along with their advocate participated in mediation and the parties identified each other and the parties have resolved their dispute and have agreed to the following terms and conditions:- 1. The Petitioners are Hindus by religion and state that their marriage was solemnized on 19.11.2023 - 5 - HC-KAR NC: 2026:KHC:33726 CRL.P No. 8708 of 2026 at Vishnupriya Convention Center, Sunkadakatte, Bengaluru as per Hindu rites and customs. Subsequently, their marriage was registered on 25.01.2024, before the Registrar of Marriages, Doddaballapura, vide certificate No.DBP-HM588- 2023-24, stored in C.D.No.DBPM61. 2. Due to irreconcilable differences and incompatibility of temperaments, the parties have been living separately since 24.02.2025. The efforts made by the elders, friends and well- wishers to resolve the differences between the parties did not yield any positive result. There is absolutely no chance of reunion amongst them. Hence, the parties have decided to get the marriage between them dissolved by a decree of divorce. 3. Both petitioners state that they have no children born to them from this marriage. 4. The 1st petitioner has agreed to pay a sum of Rs.18,00,000/-(Rupees Eighteen Lakhs Only) to the 2nd petitioner towards all her claims of permanent alimony as full and final settlement by way of Demand Draft bearing No.980896, dated: 28.04.2026, Drawn on Canara Bank, Nagarabhavi 2nd Stage Branch, Bengaluru. The 1st petitioner has agreed to be handed over the Demand Draft to the 2nd petitioner before the Hon'ble Court at the time of reporting settlement. 5. The 2nd petitioner has agreed to hand over Mangalasutra Chain with two Thali, two Gundus to the 1st petitioner before the Hon'ble Court at the time of reporting settlement. 6. The 2nd petitioner agreed to withdraw or take steps for closing or quashing of Crime No.18/2026, filed by her against the 1st petitioner and his parents and his two sisters under section 115 (2), 190, 351 (2), sec. 352 r/w. 85 B.N.S.S. sec. 3 & 4 of DP Act, pending before Women's Police Station, Doddaballapur. The 1st petitioner agreed to Co- operate for the same. - 6 - HC-KAR NC: 2026:KHC:33726 CRL.P No. 8708 of 2026 7. Both petitioners agree and state that they have no claims of whatsoever nature against each other either past, present or future including movable or immovable properties belonging to each other. 8. Both petitioners state that except the above, there are no other cases pending against each other in any court of law. 9. The parties admit and agree that there is no collusion or force, fraud or any undue influence in filing the above petition and entering into this compromise in the aforesaid manner. 10. Both the parties admit that they shall not interfere in the lives of each other in future. IV. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to pass a decree of divorce, between the parties dissolving the marriage registered on 19.11.2023 at Vishnupriya Convention Center, Sunkadakatte, Bengaluru and cancel their marriage certificate registered on 25.01.2024, before the Registrar of Marriages, Doddaballapura, vide certificate No.DBP-HM588- 2023-24, stored in C.D.No.DBPM61. by granting a decree of divorce in terms of the aforesaid agreement. V. Parties will appear before the Hon'ble Court on 29.04.2026 for passing orders in terms of the agreement." 4.
