Since it is seen that the offences alleged are punishable with seven years or less than seven years, the respondent/State is directed to comply with the mandate in Section 35(3) of the BNSS, 2023 and all the directions given by the Hon’ble Supreme Court of India in the judgment in Arnesh Kumar vs. State of Bihar1 and other related rulings. 6.
