GP FOR HOME 4 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14948/2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India by the petitioners seeking the following relief: “…to issue a writ, order or direction more particularly one in the nature of a WRIT OF MANDAMUS declaring the action of the Respondent No. 3 in interfering with Petitioners Property situated in Survey No.405-1 A, measuring Ac.11.46 paiki, out of which Ac.2.00 paiki, Ac.1.50 paiki and Ac.0.37 2 (0.150 hectares) Garladinne Mandal, Ananthapuramu Registration District bounded East Land of Bella Narayanappa West NH-7 Bypass Road North Remaining land of B.Obuleshu and South Land of B. Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioners submitted that the respondent-police are interfering in civil disputes between the petitioners and the unofficial respondents. 5 4. Learned Assistant Government Pleader for Home submitted the written instructions received from the Station House Officer, Garladinne Police Station, and the relevant portion of the written instructions is extracted hereunder: “It is respectfully submitted that basing on a complaint lodged by the 4th respondent with regard to apprehension of breach of peace and law and order issues arising out of the property dispute between both parties, the Station House Officer only initiated a preliminary enquiry in accordance with law. As part of such enquiry, the police merely requested both parties to appear before the police station for the purpose of ascertaining the facts and to ensure maintenance of peace and tranquility in the locality. Except such lawful enquiry, no coercive steps whatsoever were taken against the petitioners. It is further submitted that though intimation were given to both parties to appear before the Station House Officer for enquiry, the petitioners never appeared before the police till date. Without cooperating in the enquiry process, the petitioners have approached this Hon'ble Court with false and untenable allegations as though the respondent police are interfering in the civil dispute. It is submitted that the respondent police are only discharging their lawful duties in maintaining public order and preventing any untoward incidents between the rival groups. The allegations that the police threatened the petitioners, attempted to dispossess them, or compelled them to compromise the matter are absolutely false and denied. The respondent police have neither interfered with the pending civil proceedings nor violated any injunction order passed by the competent civil court.” 5. Recording the above instructions, the Writ Petition is disposed of. However, the respondent-police are directed not to interfere in the civil disputes without following due process of law.
