Counsel for the Petitioner: 1. THANJAVURU VENKATA SUMAN Counsel for the Contemnor(S): 1. Y KOTESWARA RAO 2. J DILEEP KUMAR 3. The Court made the following: 3 THE HONOURABLE SRI JUSTICE T.C.D.SEKHAR CONTEMPT CASE NO: 3822/2025 The Court made the following Order: The present Contempt Case is filed against the respondents alleging that they have violated interim order dated 02.05.2025 passed in W.P.No.11951 of 2025. 2. It is the case of the petitioner that this court directed the respondents not to interfere with the possession of the petitioner in respect of the land admeasuring an extent of Ac.1.58 cents in RS.No.279/1/E of Kapalakunta Village, H/o Gunnampalli Village of Dwaraka Tirumala, Mandal, West Godavari District. 3. On perusal of the affidavit filed in support of the contempt case, it is stated that the respondents started digging activity and removed the stones laid around the subject land on 17.11.2025. By virtue of the said action it is contented that the respondents have violated the order passed by this court. 4. On the other hand, the 7th respondent filed counter-affidavit stating that, the respondents never interfered with the subject land nor violated the orders of this court as alleged by the petitioner. It is further averred in the counter- affidavit that in order to recover the house tax pertaining to the property in Door No.3-1-93, belonging to one Smt.Vijayalakashmi, who is the adjacent owner of the petitioner’s property, the 7th respondent went there and did not involve in digging activity as alleged. Though, the counsel for the petitioner 4 strenuously submits that the respondents have interfered with her possession and enjoyment by flouting the orders of this court, to substantiate the same nothing is placed on record except making bald allegations in the affidavit filed in support of the contempt case. Further on perusal of the photographs filed along with the contempt case would also reflect that there is no digging activity as alleged by the petitioner in the subject property. 5. In view of the above, there are no merits in the present contempt case. Accordingly, the Contempt Case is dismissed. As a sequel, pending applications, if any, shall stand closed. _____________________ JUSTICE T.C.D.SEKHAR Date 30.01.2026 KKV
