JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court calling in question proceedings in C.C.No.201/2019, pending before the IV Addl. Chief Judicial Magistrate at Bengaluru, for the offences punishable under Sections 420, 504, 506, 120(B) read with Section 34 of Indian Penal Code. 2. Heard Sri.Pratheep K.C, learned counsel appearing for the petitioners, Smt.Waheeda M.M, learned HCGP appearing for respondent No.1, Sri.A.V.Raghavendra, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: - 4 - HC-KAR NC: 2026:KHC:34123 CRL.P No. 9744 of 2026 “1. We state that, a complaint was filed by K.S Ashok who is none other than the husband of respondent No.1. The said FIR culminated into charge sheet in C.C No. 201/2019 for the offence U/S 420, 120-B, 504, 506, 34 of IPC. 2. We state that, during the pendency of the criminal case, on the account of intervention of elders and family members we have decided to put a quietus to the entire litigation accordingly, the proceedings in C.C No.201/2019 may kindly be quashed. 3. We state that, in terms of compromise between the parties the petitioners have agreed to pay a sum of Rs.6,00,000/- to respondent No.2 through demand draft dated 22.06.2026 bearing No.446008 drawn on Canara bank, Chowkahalli branch and same is handed over to respondent No.2 today and respondent No.2 acknowledges the receipt of aforesaid amount. 4. We state that, in view of the compromise, the Respondent No.2 has agreed to withdraw a suit in O.S No. 7155/2017 pending on the file of CCH-59, Bangalore. Further respondent No.2 agrees to withdraw case in Crl. A No.2033/2025 pending before this Hon'ble court within one month from today. 5. We state that, the petitioners have also filed a suit against the respondent No.2 herein in O.S No. 854/2017 on the file of Principal senior civil judge, Bangalore rural and petitioners agreed to withdraw the said suit within one month from today. 6. We state that, the compromise entered without coercion. Further the compromise is free of will. Therefore it is prayed before this court to quash the entire Proceedings against the petitioners. 7. We state that, on the account of some misunderstanding a complaint came to be registered against the petitioners herein. WHEREFORE, we most humbly prayed that this Hon'ble court may kindly be permitted the parties to compound the offences punishable U/S 420, 120-B, 504, 506, 34 of IPC and quash the entire proceedings against the petitioners in - 5 - HC-KAR NC: 2026:KHC:34123 CRL.P No. 9744 of 2026 C.C No.201/2019 pending on the file of Hon'ble IV ACMM, Bengaluru in the interest of Justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. Petitioners hands over demand draft of Rs.6,00,000/- to the learned counsel appearing for respondent No.2 and the same is acknowledged by them. 6. In the light of application for compounding being filed along with the joint affidavit as quoted supra and offences not being against the State, I deem it appropriate to accept the joint affidavit and terminate the proceedings against the petitioners in the subject petition. 7.
