Rakib (Rejected) CRM (M) 1125 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ausgram Police Station case no. 09 of 2024 dated 07.01.2024 under Sections 395/397/412 of the Indian Penal Code, 1860. And In the matter of : Bijon Biswas @ Jhatka ……Petitioner. None appears for the petitioner or for the State. I have taken into account the materials available on record. The subject matter of the case reflects offences being committed under Sections 395/397/412 of the Indian Penal Code. Petitioner was arrested after 15 days of the incident. Records further reveal that several gold ornaments were recovered which were identified in the T.I. Parade. 7 of the accused persons were also identified in the T.I. Parade. Against some of the persons another case being Ausgram police station case no. 384 of 2023 was registered which was investigated in respect of the self-same nature of offence. Having considered the same nature of the offence committed, I am of the opinion that this is not a fit case for granting bail at this stage when the evidence is in progress. Accordingly, CRM (M) 1125 of 2026 is dismissed. Learned trial Court would expedite the process of trial. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
