Gupta Mr. Sharadindu Patra Ms. Sofia Nesar Mr. Santanu Seth ….for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Sr. Div.), 3rd Court at Howrah to dispose of the application under Order 39, Rule 1 and 2 of the Code of Civil Procedure filed in connection with the Title Suit No. 309 of 2024 expeditiously. It appears from the order-sheets appended to this application that the plaintiffs/petitioners herein were directed to comply with the provisions under Order 39 Rule 3(a) and Rule 3(b) of the Code of Civil Procedure. The learned advocate appearing for the petitioners could not apprise this Court as to whether such directions have been complied with or not. CO 2099 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 3rd Court at Howrah to make an endeavour to dispose of the injunction application, if the same is otherwise ready for hearing as expeditiously as possible. Accordingly, CO 2099 of 2026 stands disposed of. There will be no order as to costs. 2 All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
