This petition has been filed under Article 227 of the Constitution of India for quashing and setting aside order dated 13.05.2026 passed in Misc. Case No. 01 of 2023 by the learned Tribunal, Godda under Coal Bearing Areas Act.

Learned counsel for the petitioner submits that the learned Court has been pleased to dismiss the said case for default and in view of that this petition has been filed.

Learned counsel for the O.P. Nos. 2 and 3 submits that petitioner’s remedy is there to file the petition before the learned Tribunal for recalling and re-admitting the said Misc. Case however, without doing so the petitioner

straightway has filed the present petition before this Court.

It transpires from the record that petitioner has not filed petition before the learned court to recall and re-admit the said Misc. Case and straightway this petition has been filed. The provisions are there of re- admitting the case under the C.P.C. In view of that this petition is disposed of with liberty to the petitioner to file appropriate petition before the Tribunal under Order XXII Rule 9 of C.PC for recalling the said order dated 13.05.2026 passed in Misc. Case No. 01 of 2023.
6. This petition is disposed of with the aforesaid liberty. Pending I.A., if any, stands disposed of.
