Upadhyay, Advocate For the State : Ms. Nehala Sharmin, Spl.PP …...... 02 /18.09.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 17(b)/21(b) /27(a) of the NDPS Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. This is the second attempt by the petitioner for grant of bail. His prayer for grant of bail was earlier rejected vide order dated 27.02.2026 in B.A. No. 1021 of 2026. 4. Learned Spl.PP produced the FSL report before this Court and opposes the prayer for bail. She submits that the petitioner was apprehended and narcotic substance weighing about 5.31 gram was recovered from him. The material recovered is as per the FSL report is Heroin. 5. Considering the fact that the material recovered is heroin, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Adityapur P.S. Case No. 337 of 2025, NDPS Case No. 45 of 2025 (MCRA No. 387 of 2026), pending in the Court of learned Sessions Judge, Seraikella Kharsawan stands rejected. 2026:JHHC:28296 2 6. Accordingly, this bail application is dismissed. 7. It is expected that the FSL report will also be placed before the trial court and the Trial Court should take steps to conclude the trial at the earliest.
