Also heard Shri Prasun Bhaduri, learned Dy AG for the State, Shri Shashank Thakur, learned counsel for the University, and Ms Anmol Sharma, learned counsel for the Union of India. 1. Petitioner has filed this petition for the following reliefs: “10.1 That, this Hon’ble Court may kindly be pleased to call the entire records relating to this case. 10.2 That this Hon’ble Court may kindly be pleased to allow the petition and declare ultra vires para 2 of the impugned Notification dated 18.03.2025 issued by the respondent no.3 with respect to pay and allowances against the service benefits as granted to the petitioner under the established service rules and conditions of the Appointment Order. 10.3 That this Hon’ble Court may kindly be pleased to pass a direction to the respondents to restore the status of the petitioner in terms of Para 1 of the impugned Notification dated 18.03.2025. 10.4 That this Hon’ble Court may kindly be pleased to set aside the impugned Order dated 08.04.2025 issued by the Wpc 5259 of 2026 3 respondent no.3 and direct respondent Indira Gandhi Krishin Vishwavidyalaya to restore the pay and allowances with social security measures like GPF and other allowances as was being paid before issuing the impugned order dated 08/04/2025. 10.5 That this Hon’ble Court may kindly be pleased to direct that the superannuation age of the petitioner shall be 65 years as per the amendment under Statute 9(4) effected vide letter no.4444/6523/2012/ रासधयु - 2 रायुपुरा, दि नांक 25/08/2012 of the Additional Secretary to the Governor of the State of Chhattisgarh (P/13). 10.6 Any other relief, which this Hon’ble Court may deem fit and proper, together with the cost of the petition.” 2. Learned counsel for the petitioner would submit that he has only challenged the notification dated 18.03.2025. However, in the prayer/relief clause-10.2, the vires of the said notification has been inadvertently challenged. He would further submit that the impugned notification dated 18.03.2025 has already been challenged in a bunch of writ petitions pending consideration before this court ie WPS-3288 of 2025 and other connected petitions, challenging the same notification. 3. In such a situation, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file duly constituted petition. Wpc 5259 of 2026 4 4. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government Observation Home, Raipur. 5. Registry is directed to return the certified copies of the annexures to the learned counsel for the petitioner after retaining the attested true copy of the same.
