The petitioner is an accused in connection with Rail Hatia P.S. Case No. 13 of 2024 (N) corresponding to N.D.P.S. Case No. 86 of 2024. The prayer for bail of the petitioner was earlier rejected twice. It has been submitted by the learned counsel for the petitioner that the petitioner is in custody since 19.05.2024 and he does not have any criminal antecedent. It has further been submitted that from the possession of the petitioner 16 kg. of Ganja was recovered which is less than the commercial quantity. Learned Special P.P. for the State has opposed the prayer for bail of the petitioner. It seems that from the joint possession of the petitioner and other accused 69 kg. of Ganja was recovered and considering the quantity of Ganja recovered and the recovery being specific from the petitioner as well, I am not inclined to admit the petitioner on bail and the present application stands rejected once again at this stage.
