And In the matter of : Tapu Parui ……Petitioner. Mr. Angshuman Chakraborty Mr. S. S. Saha .....for the Petitioner. Affidavit-of-service filed by the petitioner be kept with the record. Learned advocate appearing for the petitioner submits that petitioner is in custody since 09.02.2026. According to the petitioner he had a relationship with the victim and has been falsely implicated in connection with the instant case. None appears on behalf of the State. I have taken into account the overall circumstances from the records of the case as placed by the learned advocate appearing for the petitioner. Admittedly, the victim is about 15 years of age. She was pregnant when the incident surfaced. Having considered the circumstances appearing, I am of the view that at this stage without the evidence of the victim being 2 complete, it would be premature to release the petitioner on bail. As such the prayer for bail of the petitioner is dismissed. However, the learned trial Court is directed to overcome the stage of consideration of charges and within a period of three months examine the victim under Section 35 of the POCSO Act. In view of the directions passed above CRM (M) 1124 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
