The petitioners who are the members of Budhigram Gram Panchayat submitted a no confidence motion against the Pradhan of the Panchayat before the Prescribed Authority on June 11, 2026 which was received by the latter on the same date. Learned counsel for the petitioners, in his usual fairness, submits that the requisition notice contains stigma against the Pradhan and cannot be sustained. The petitioners seek liberty to file a fresh requisition in terms of Section 12 of the West Bengal Panchayat Act, 1973. Upon consideration of the submission made on behalf of the parties, this Court directs that the requisition notice dated June 11, 2026 be quashed in view of the stigma recorded therein against the Pradhan. The petitioners are at liberty to file a fresh no confidence motion before the Prescribed Authority in terms of Section 12 of the Act of 1973. On receipt of such motion, the Prescribed Authority and Block Development Officer, Rampurhat-II Development Block, being the 5th respondent herein, shall proceed with the same in terms of Section 12 of the Act, particularly the time frame prescribed therein. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
