For the O.P. : A.P.P. --- 02/25.09.2026 Heard Mr. Shekhar Prasad Sinha, learned counsel for the petitioner and learned A.P.P. The prayer for bail of the petitioner was earlier rejected in B.A. No. 2305 of 2025. It has been submitted by learned counsel for the petitioner that the informant and the petitioner were quarreling and when Hiramoti Hansda had intervened to quell the quarrel, the petitioner had committed assault upon her which resulted in her death and, therefore, the same would come within the purview of an offence punishable under Section 304 Part II IPC. It has been submitted that the petitioner is in custody for more than 05 years. Learned A.P.P. has opposed the prayer for bail of the petitioner. It seems that the petitioner had initially assaulted one Rakhi Balmiki and subsequent thereto the deceased with a dau as a result of which the deceased succumbed to her injuries. Regard being had to the specific nature of allegations levelled against the petitioner, I am not inclined to grant bail to him. His prayer for bail is hereby rejected once again at this stage.
