PUBLIC PROSECUTOR 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 12652/2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/Accused No.5, seeking regular bail, in Crime No.27/2025 of Munchingiput P.S., Alluri Sitharama Raju District, registered for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(C) of the NDPS Act. 2. Brief facts of the case are that, on 22.05.2025 at 16:00 hrs, on credible information, the SI of Munchingiput P.S., secured the presence of mediators and proceeded to Labburu Junction, Munchingiput Mandal, Alluri Sitharama Raju District for vehicle checking, wherein, the accused were caught while they were illegally transporting and in possession of contraband of 350 Kgs of Ganja in 12 white colour packets. The contraband and other material was seized under the cover of mediators’ report. The Accused Nos. 1 & 2 were arrested on spot. The other accused were arrested later on basing on the confession of the arrested accused. 3. None represented on behalf of the petitioner. This petition is filed seeking regular bail, as the petitioner is in jail, this Court has proceeded with the matter by hearing Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3 4. Learned Assistant Public Prosecutor submits that the quantity of contraband involved in present crime is 350 Kgs of Ganja, which is a commercial quantity. The A-5 has been in judicial custody since 01.09.2025. She would further submit that the statutory period of 180 days is not over and investigation is still pending. Learned Assistant Public Prosecutor finally prays for dismissal of the petition in the light of the bar under Section 37 of NDPS Act. 5. In view of the aforesaid facts and circumstances of the case, the petitioner does not deserve for grant of regular bail at this stage. Accordingly, the Criminal Petition is dismissed. As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed. __________________________________________ DR.
