The Court made the following ORDER:
The present Civil Revision Petition is filed against the Docket order dated 01.12.2025, passed by the learned Principal Junior Civil Judge, Tirupati, in E.P.No.113 of 2024 on O.S.No.225 of 2020.
The petitioner herein is the defendant in the said suit. The suit was
decreed on 08.11.2023 for a sum of Rs.11,93,217/- with interest. Against the said Judgment and Decree the learned counsel for the petitioner submits that an appeal has been preferred with some delay and in the meanwhile the respondent / decree holder is proceeding with the Execution proceedings. He submits that without taking into consideration that the Appeal against the Judgment and Decree has been preferred and the same is pending adjudication before the Appellate Court, the learned Executing Court is insisting for disposal of the said E.P. without granting time.
Considered the submissions made by the learned counsel for the petitioner and perused the material on record.
A Revision Petition is not maintainable against the order dated 01.12.2025 passed in the E.P., simply adjourning the matter for further evidence. Therefore, the Civil Revision Petition is dismissed. However, it is left open to the petitioner to pursue the Appellate Court for disposal of the delay petition stated to have been filed in the appeal against the
judgment and decree in O.S.No.225 of 2020. No costs.
3
Consequently, the Miscellaneous Applications pending, if any, shall also stand dismissed.
